PROVIDER DATA TERMS

How RehabFinder may use your service's information.

Version RF-DATA-1 (interim), in use from 15 October 2026 while it is reviewed by our lawyer. Any change is published under clause 10.4.

These terms govern what RehabFinder may do with the information a treatment service gives it. They sit beside, not inside, any commercial agreement. They are accepted in the provider portal, under Data upkeep.

1. Who these terms are between and when they apply

1.1 These terms are between RehabFinder Trading Pty Ltd (ABN 80 692 356 120) (RehabFinder, we) and the organisation that operates the treatment service named when they are accepted (you).

1.2 They apply to information you give us about that service from the day you accept them. Where you operate several services, you accept them for each service.

1.3 They are accepted by a person authorised to bind you, through the RehabFinder provider portal. We record the account they used, their role, the date and the version accepted.

1.4 They cover how we use your service’s information. They do not set any fee; any commercial arrangement is a separate agreement. If the two conflict on the use of information, these terms prevail.

1.5 Nothing in these terms is a client’s consent, and nothing in them authorises anyone to refer a client to you. A client’s consent and a referral belong to the referral itself.

2. Definitions

Service information: everything you give us about the service: questionnaire answers, structured details (such as credentials, therapies, prices, admission rules), availability reports, photographs and supporting documents. It does not include information about any client.

Published: approved by a RehabFinder administrator after you submit it. Approval publishes your statement; it is not verification.

Verified professional: a registered health or allied professional whose identity and registration RehabFinder has checked, using the professional workspace.

AI-assisted answers: answers, comparisons and summaries a verified professional obtains from software that uses automated language processing over published service information.

Client report: a document a verified professional prepares for a particular client from service information cleared for client reports, frozen as it stood on the day it was made.

Verification: an independent check by RehabFinder of a specific fact, recorded with its method, scope and date.

Restriction: a limit you place on how one answer may be used under clause 5.

3. What you give us and your promises about it

3.1 You give us service information through the portal. You own it; these terms give us permission to use it, not ownership of it.

3.2 You promise that, when you give it:

  1. it is true and not misleading, or you have said it is an estimate, not known, not applicable or not for disclosure;
  2. a correction of our research says why;
  3. you have the right to give it to us, including any photograph, document or third party’s material in it.

3.3 You promise that nothing you give us is a testimonial about the clinical aspects of your service, or would make your listing misleading or deceptive advertising.

3.4 The person who accepts these terms promises they are authorised to do so for you.

3.5 You must not give us information about any client or prospective client, or any document containing it.

3.6 You give us a non-exclusive, royalty-free licence to store, display, reproduce and adapt service information for the uses in clause 4, for as long as these terms apply and as clause 8 says afterwards.

4. How RehabFinder may use your information

4.1 We may use published service information in four ways, and no other. The portal shows, beside every question, which audience it is for.

  • Public listing, seen by anyone: answers marked Public & professionals. Never prices.
  • Verified professionals, seen by verified professionals only: public answers, answers marked Professionals only, structured details, prices and live availability. Includes AI-assisted answers unless you refuse them (clause 5).
  • Client reports, seen by a client through their verified professional: only answers RehabFinder has cleared for client reports, plus stay prices, packages, price items, funding arrangements and waitlist rules, unless you refuse client reports (clause 5).
  • Internal checks, RehabFinder only: everything, including answers marked RehabFinder only, clinicians’ names and registration numbers, and supporting documents, to check and maintain the listing.

4.2 We may also use service information in aggregate, without identifying your service, to improve the directory and to report on the sector.

4.3 Supporting documents are used under clause 9 only.

5. Your choices

5.1 When you accept these terms you choose, for the service as a whole:

  1. whether your answers may be used in AI-assisted answers for verified professionals; and
  2. whether your answers cleared for client reports may go into client reports.

5.2 You may also restrict any single answer from AI-assisted answers, or from client reports, giving a reason.

5.3 A choice or restriction only narrows use. It never makes an answer visible to a wider audience than clause 4 allows.

5.4 A refusal or restriction applies to information you gave us. It does not apply to RehabFinder’s own research, or to internal checks.

5.5 You can change a choice or withdraw a restriction at any time in the portal. A change applies from then on; it does not recall a client report already issued (clause 8.3).

6. What RehabFinder does not do

6.1 We do not verify your answers by publishing them. A fact is described as checked only where we have recorded an independent check of it.

6.2 We do not show unanswered, not-known or not-for-disclosure answers as “no”.

6.3 We do not show prices, clinicians’ names or registration numbers, or answers marked RehabFinder only, to anyone outside RehabFinder, except prices to verified professionals and in client reports as clause 4 allows.

6.4 We do not let payment affect the ranking, order or prominence of any listing.

6.5 We do not sell service information, and we do not pass it to another treatment service.

6.6 We do not give clinical advice, assess any client or decide any admission. Those decisions stay with you and the referring professional.

7. Keeping information current

7.1 You name, from your team in the portal, an owner and a backup for each kind of information and how often it is reviewed.

7.2 You update the portal the same day if any of these change: what you treat or how you manage withdrawal or medicines, your admission rules, or your staffing and clinical cover. You record a temporary closure, or a pause on admissions, with its dates.

7.3 You reconfirm each kind of information by its review date, or update it. We remind the named owner and backup beforehand.

7.4 Live availability is treated as unconfirmed 24 hours after your last report, whatever else is set.

7.5 Information past its review date is shown to verified professionals as due for reconfirmation. We may suspend part or all of a listing that stays overdue, or that we believe is materially wrong, after telling you.

8. History, withdrawal and ending these terms

8.1 We keep every published version of every answer, with who stated it and when. This record is how a professional can see what a listing said on a given day, and we do not delete it.

8.2 You can withdraw an answer, a structured detail or a document at any time. We stop showing and using it from then on, except for internal checks and the record in clause 8.1.

8.3 A client report is frozen when a professional makes it. Withdrawing information, or changing a choice under clause 5, does not change a report already issued.

8.4 Either of us may end these terms by notice through the portal or in writing. On ending, clause 8.2 applies to all your service information, and our right to show your listing from your information ends. RehabFinder may continue to list your service from its own research, as it does for services that have not accepted these terms.

8.5 Clauses 3, 8, 9 and 10 survive the end of these terms.

9. Privacy, confidentiality and documents

9.1 We handle any personal information in service information, such as a staff member’s name, under the Privacy Act 1988 (Cth) and our privacy policy. You confirm you may give it to us for these uses.

9.2 Supporting documents are stored privately. A verified professional can open one only if you allowed professional use of it and RehabFinder has reviewed that version; each opening uses a link that expires after one minute. Reviewing a document is not verifying it.

9.3 We keep answers marked RehabFinder only, clinicians’ names and registration numbers, and documents you have not released, confidential, and use them only for internal checks.

9.4 We do not run malware scanning on documents. We accept only PDF, JPEG and PNG files of up to 10 MB, and check each file’s type when it arrives.

10. Liability, changes and governing law

10.1 Service information is your statement. You are responsible for its accuracy, and you indemnify us against claims arising because it was untrue, misleading or infringing when you gave it.

10.2 We take reasonable care to show service information as you gave it and as these terms allow. We do not warrant that the directory is uninterrupted or free of error.

10.3 To the extent the law allows, our total liability under these terms is limited to the greater of $1,000 and the fees you paid us in the 12 months before the claim. Nothing limits a right you have under the Australian Consumer Law that cannot be excluded.

10.4 We may publish a new version of these terms. We tell you through the portal at least 30 days before it applies, and it applies only once you accept it; until then the version you accepted continues.

10.5 These terms are governed by the law of New South Wales, and the courts of that state have jurisdiction.
